Please read these terms carefully before using BabaHub.
These Terms & Conditions ("Terms") govern your access to and use of the BabaHub website and mobile application (together, the "Platform"), operated by BabaHub. By creating an account, browsing, or placing an order on the Platform, you agree to be bound by these Terms.
1. Your Account
You must provide accurate information when creating an account and are responsible for keeping your login credentials confidential. You're responsible for all activity that occurs under your account. We may suspend or disable an account that we reasonably believe is being used fraudulently or abusively.
2. Orders & Pricing
Product prices and availability are subject to change without notice. Placing an order is an offer to purchase; we may decline or cancel an order (for example, due to a pricing error or stock unavailability), in which case any payment already taken will be refunded. An order is confirmed once you receive an order confirmation with an order number.
3. Payments
Payments are processed securely through our third-party payment gateway (PayFast). We do not store your full card details on our servers. You must only use payment methods that you are legally authorized to use.
4. Delivery
Delivery timeframes shown at checkout are estimates and depend on your location and product availability. Risk in the goods passes to you once they are delivered to the address you provided.
5. Returns, Refunds & Cancellations
Orders can be cancelled before they are processed or shipped. If you receive a damaged, defective, or incorrect item, contact our support team within 24-48 hours of delivery with your order ID so we can arrange a replacement or refund. See our Returns & Exchanges page for details.
6. Reviews & User Content
When you submit a product review or other content, you confirm it's honest and doesn't infringe anyone else's rights. We may remove content that violates these Terms or is unlawful, abusive, or misleading.
7. Intellectual Property
The BabaHub name, logo, and the Platform's content and design are owned by BabaHub or its licensors and may not be copied or used without permission.
8. Limitation of Liability
To the fullest extent permitted by law, BabaHub is not liable for any indirect or consequential loss arising from your use of the Platform. Nothing in these Terms limits any liability that cannot legally be limited, including for fraud or death or personal injury caused by negligence.
9. Changes to These Terms
We may update these Terms from time to time. Continuing to use the Platform after a change takes effect means you accept the updated Terms.
10. Governing Law
These Terms are governed by the laws of South Africa.
